FairStamp.com Terms of Service
Effective Date: December 19, 2024
These Terms of Service ("Terms") govern access to and use of the Fairstamp.com website and services (the "Services"), operated by:
- Wave 3 LLC (Texas)
- Shenandoah Systems LLC (Texas, Qualified Opportunity Fund)
- Wave 3 Digital Trust LLC (Texas, OZ Operating Company)
Collectively, "Fairstamp," "we," "us," or "our."
By accessing or using the Services, you agree to be legally bound by these Terms. If you do not agree, do not use the Services.
1. Nature of the Services (No Guarantees)
Fairstamp provides digital tools that may include, without limitation:
- document time-stamping and hashing
- issuance of digital receipts
- coupon or credit representations
- optional display of passes in third-party wallets
- AI-assisted summaries or interfaces
- cryptographic or metadata-based verification artifacts
Fairstamp does not provide legal, financial, medical, tax, mental health, or professional advice of any kind.
All Services are provided "AS IS" and "AS AVAILABLE."
2. No Fiduciary Duty / No Reliance
You expressly agree that:
- Fairstamp owes you no fiduciary duty
- You may not rely on the Services for decisions involving:
- money
- legal rights
- health or safety
- compliance
- risk assessment
- Any action you take based on the Services is solely your responsibility
Fairstamp does not monitor, evaluate, or validate user intent.
3. Wallet Passes & Coupons (Authoritative Record Rule)
Fairstamp may allow you to load coupons, credits, or receipts into third-party digital wallets (e.g., Google Wallet, Apple Wallet).
You acknowledge and agree:
- Wallet passes are non-authoritative convenience displays only
- Fairstamp's internal records exclusively control all balances, usage, and entitlements
- Wallet providers are not parties to your agreement with Fairstamp
- Wallet providers are not responsible for credits, refunds, or availability
- Wallet deletion, corruption, sync failure, or removal does not create liability for Fairstamp
Fairstamp may revoke, invalidate, or reissue wallet passes at any time for fraud prevention, chargebacks, technical correction, or policy compliance.
4. Payments, Coupons, and Refunds
Payments are processed through third-party processors (e.g., Stripe).
Refund Policy
- 30-Day Money-Back Guarantee: If you are unsatisfied with your purchase, you may request a full refund within 30 days of purchase, provided you have not used more than 10% of your purchased stamp credits.
- Refund requests must be submitted to support@fairstamp.com
- Refunds are processed to the original payment method within 5-10 business days
- Abuse of the refund policy may result in account termination
Coupon Validity
- One-Year Validity: All purchased stamp coupons are valid for one (1) year from the date of purchase
- Unused credits expire at the end of the validity period and are not refundable
- Coupons and credits have no cash value
- Coupons do not represent stored value, securities, or investments
General Terms
- Chargebacks, abuse, or fraud may result in account termination
- Fairstamp does not guarantee availability, redemption, or future acceptance of any coupon or credit beyond the stated validity period
5. AI-Assisted Features (No Advice / No Causation)
Some features may include AI-generated content.
You acknowledge:
- AI output may be incorrect, incomplete, misleading, or fictional
- AI does not provide instructions, advice, or directives
- AI is not a substitute for human judgment
- Fairstamp has no duty to prevent, correct, or intervene
Fairstamp is not liable for actions taken by users based on AI output, including claims involving emotional distress, self-harm, criminal acts, or wrongful death.
6. Receipt Validity & Verification
Fairstamp receipts contain cryptographic proofs that can be independently verified.
- Receipt Validity Period: Timestamped receipts are valid for ten (10) years from the date of issuance, as indicated in each receipt's metadata
- Verification Service: Online verification tools are available during service operation at fairstamp.com/verify
- Open Source Verification: Fairstamp provides open source verification code that allows independent validation of receipts without relying on Fairstamp's servers. This code is included in receipt downloads and available on our public repository.
- Self-Contained Proofs: Each receipt contains all information necessary for verification: the original file's SHA-256 hash, timestamp, and metadata. No ongoing service access is required to prove a file existed at a given time.
Fairstamp does not guarantee uninterrupted availability of online verification services, but the open source tools ensure verification remains possible regardless of service status.
7. Prohibited Use
You may not use the Services to:
- violate any law or regulation
- engage in fraud, deception, or abuse
- facilitate self-harm, violence, or criminal acts
- upload illegal, infringing, or harmful content
- reverse engineer or bypass security
- misrepresent affiliation or endorsement
Fairstamp may suspend or terminate access at its sole discretion, without notice.
8. Intellectual Property
All Fairstamp content, software, trademarks, and systems are owned by Fairstamp or its licensors.
You receive a revocable, non-exclusive, non-transferable license for personal use only.
No rights are granted by implication.
9. Independent Development / No Partnership
Nothing in these Terms creates any partnership, agency, employment, or joint venture.
Fairstamp may independently develop products or services that compete with or resemble user projects without obligation or liability.
10. Third-Party Services
The Services may integrate with third parties.
Fairstamp:
- does not control third-party services
- is not responsible for their availability, security, or conduct
- disclaims all liability arising from third-party failures
Your use of third-party services is governed by their own terms.
11. Indemnification
You agree to indemnify and hold harmless:
- Fairstamp
- all affiliated entities
- officers, managers, employees, contractors
- Darrell L. Young personally
from any claim, loss, damage, liability, cost, or expense (including attorneys' fees) arising from:
- your use of the Services
- your content or conduct
- your reliance on outputs
- wallet usage
- third-party claims
- estate or survivor claims
12. Limitation of Liability
To the maximum extent permitted by law:
- Fairstamp's total aggregate liability is limited to the lesser of (a) amounts actually paid by you to Fairstamp in the twelve (12) months preceding the claim, or (b) USD $100.
- Fairstamp is not liable for:
- indirect or consequential damages
- lost profits
- emotional distress
- personal injury or death
- reliance damages
- data loss
- wallet failures
- AI output consequences
13. Arbitration & Venue
All disputes shall be resolved by binding arbitration in Hunt County, Texas.
- No class actions
- No representative claims
- No jury trials
If arbitration is unavailable, exclusive venue is state or federal courts in Hunt County, Texas.
Texas law governs.
14. Modifications
Fairstamp may modify these Terms at any time.
Continued use constitutes acceptance.
